What is a Statement of Environmental Effects?

 

A Statement of Environmental Effects is a written report that identifies the potential environmental impacts of a proposed development, the mitigation measures, and how the proposal complies with local and state planning controls. It supports council’s statutory assessment under the Environmental Planning and Assessment Act 1979 (EP&A Act) and the EP&A Regulation 2021.

  • Required for most DAs in NSW (designated development generally requires an Environmental Impact Statement (EIS) rather than a SEE).
  • Councils assess DAs having regard to Section 4.15 matters (planning controls, likely impacts, site suitability, submissions, public interest).

When do you need a SEE?

You’ll need a SEE for most development applications—from minor residential alterations to complex commercial proposals. The EP&A Regulation 2021 sets DA content requirements (including accompanying documents), and councils commonly require a SEE to explain impacts and compliance. 

For designated development, an EIS is required under the Act/Regulation instead of a standard SEE.
